Terms and Conditions of Use for NUBETIC Services
1 NUBETIC by José García
These Terms and Conditions regulate the relationship between NUBETIC by José García (hereinafter "NUBETIC") and its Users (natural and corporate clients). NUBETIC is a sole proprietorship established in Venezuela, under R.I.F. No. V-18354696, with the capacity to commercialize technological services, data storage and cloud infrastructure solutions.
2 Services Provided by NUBETIC
NUBETIC is a cloud services platform that integrates third-party technologies to offer a unified collaboration and storage solution. The main services include:
- NUBETIC Cloud (Powered by Nextcloud): Storage, file management and cloud collaboration tools.
- NUBETIC Mail (Powered by Zimbra): Corporate email services and collaborative messaging.
- NUBETIC Infrastructure (Powered by OVHcloud): Server supply and processing capabilities backed by global data centers.
By accepting these terms, NUBETIC grants the User the right to use the contracted instances. The User acknowledges that NUBETIC acts as an integrator and administrator, using APIs and third-party software (Nextcloud, Zimbra, OVH), and acceptance of these terms implies acceptance of the terms of use of said end providers.
3 Intellectual Property and Platform Use
The User understands that they may not use the image, logo, brand or intellectual property elements of NUBETIC without prior consent. The following is strictly prohibited:
- Reverse engineering or sabotage attempts on the infrastructure.
- Modifying encryption or security configurations imposed by NUBETIC.
- Using the platform for illegal activities under Venezuela's Law Against Computer Crimes.
4 Force Majeure
Neither the User nor NUBETIC may demand compliance with obligations in case of force majeure events. For NUBETIC, this specifically includes:
- Massive failures in global internet infrastructure or providers (OVHcloud).
- Massive cyber attacks (DDoS, Malware) that exceed standard security measures.
- Prolonged national power service interruptions affecting local connection nodes.
5 Payment of Services
The User agrees that NUBETIC services are prepaid.
- Payment methods: Transfers in Bolivares (at the official BCV exchange rate), Zelle, PayPal, or any other means reported on the platform.
- Suspension: Failure to pay a fee will result in automatic suspension of data access. After 30 days of default, NUBETIC reserves the right to permanently delete User information for storage costs.
- No Refund: Once the service is activated, payments are non-refundable due to third-party infrastructure provisioning costs.
6 Ethics and Acceptable Use Policy
NUBETIC prohibits the use of its servers for:
- Storage of material that violates copyright.
- Distribution of spam or malware.
- Activities related to money laundering or terrorism financing (Organic Law Against Organized Crime).
7 Commercial and Labor Relations
The relationship between NUBETIC and the User is strictly commercial. The User acknowledges that there is no labor relationship with José García or the technical staff of NUBETIC. NUBETIC's responsibility is limited to the availability of the service according to the contracted plan.
8 Technical Support
Support will be channeled through:
- Ticket System: Integrated into the client platform.
- Automated Assistance: Through AI-based support bots for frequent queries.
- Hours: Human support will operate during administrative hours established by the firm.
9 Data Processing (Habeas Data)
NUBETIC guarantees the right to Habeas Data in accordance with the Constitution of the Bolivarian Republic of Venezuela. The personal data collected (Name, RIF/ID, email) is used exclusively for account management and service security. NUBETIC does not commercialize user databases with third parties.
10 Operational Definitions
- NUBETIC User: Natural or legal person who, upon acceptance of these terms, accesses cloud, email or infrastructure services.
- Technology Partner: Entities such as OVHcloud, Nextcloud GmbH or Zimbra (Synacor), that provide the base technology on which NUBETIC deploys its services.
- Platform: Any portal under the NUBETIC domain or interfaces (Nextcloud/Zimbra) through which services are provided.
- Sensitive Data: NUBETIC will not request data related to health, sexual life or biometrics. The information stored by the user in their private instances is their exclusive responsibility.
11 Purpose of Data Processing
The information collected will have the following objectives:
- Manage the provisioning of storage and email instances.
- Process billing and collection.
- Send technical updates, security alerts and maintenance notifications.
- Comply with requirements from SUDEBAN or tax authorities in case of financial transactions.
- Verify identity to prevent the use of infrastructure for phishing or malware distribution activities.
12 Data Requested
For the effective provision of the service, NUBETIC may require:
- Users: Names, RIF/ID, main email address (for recovery), phone number and billing data.
- Companies: Company Name, RIF, Articles of Incorporation, Legal Representative data and commercial references.
13 Brand and Intellectual Property Protection
The User acknowledges that logos, trade names and distinctive signs of NUBETIC are the exclusive property of José García's sole proprietorship. Use of the platform does not grant rights over the trademarks of technology partners (Nextcloud, OVH, Zimbra), whose rights belong to their respective owners.
14 Limitation of Liability
- NUBETIC is not responsible for data loss derived from user negligence (e.g., loss of passwords or failure to activate 2FA).
- Being a service based on third-party infrastructure (OVHcloud), NUBETIC does not guarantee 100% availability, although it commits to performing technical management to maintain standard industry service levels (SLA).
- NUBETIC is not responsible for the content the user decides to store in their private instances.
15 Technical Support and AI Support
Support will be provided mainly digitally. The user accepts that initial queries may be handled by automated systems (AI Bots). In case of critical incidents, they will be escalated to human personnel during administrative hours.
16 Dispute Resolution
The parties commit to exhausting the friendly settlement route. If not possible, they agree to submit to Venezuelan legislation. Any dispute will be resolved through legal arbitration in the city of Cúcuta (due to the firm's operations) or in Caracas, under the regulations of recognized commercial arbitration centers.
17 Notifications
All official communication will be considered valid if sent to the email registered by the user on the platform or through the official channels of NUBETIC.
By using NUBETIC services, the User accepts and acknowledges having read these Terms and Conditions in full.
